La prestation de serment et l'excommunication dans les tribunaux byzantins
L'auteur examine les mécanismes de la prestation de serments aux tribunaux ainsi que ceux de la menace de l'excommunication pour la déposition aux tribunaux, civils ou ecclésiastiques. L'étude montre que le remplacement du serment par la menace de l'excommunication s'est facilité par la présence des membres du clergé comme juges, mais cette évolution était principalement due aux disfonctionnements des tribunaux civils.
