Tracing the crimes of the powerful in the light of the principle of equality of all before the law: An oxymoron scheme

Abstract

The present study is an attempt to trace the criminality of the "powerful" examined through the prism of the principle of equality of all before the law. Its goal is to get as close as possible to the answer to a key question: “Is everyone equal before the law?”. What are the determinants and the parameters that concur and transform equality into inequality, equal treatment into discrimination, fair administration of justice into a selective and filtering process? With criminological theory as our guide, we will highlight an oxymoronic formation, a biased, selective and unequal way of dealing with crimes of the powerful
