Αξιολόγηση της διαδικασίας εκτίμησης των αναγκών σε πολίτες τρίτων χωρών για εργασία στην Ελλάδα και της διαδικασίας μετάκλησής τους

Abstract

National policy for the legal work of third country nationals in Greece, is aiming to regulate the inflow of legal migration in order to meet the needs of the country for labor force, to ensure the smooth and equal integration of immigrants in the labor market and to combat undeclared work. The implementation of this policy is based, for the first two objectives, on the Code of Immigration and Social Integration (Law 4251/14). A Joint Ministerial Decision, referred to article 11 of Law 4251/14, issued every two years, determines the maximum number of paid employment posts offered to third-country nationals, per region and specialty. The procedure which enables a third country national to enter and reside in Greece in order to provide paid work to a specific employer, in a specific field of employment, is called recalling. The purpose of this article is to evaluate the process of determining the number of working posts for third country nationals and the recalling procedure. The evaluation of these procedures is attempted through the presentation of the results of questionnaires sent to the competent authorities, i.e. the Regions of the country and the Decentralized Administrations. In addition, the legislative regulations concerning the entry and work of foreigners with exceptional procedures are presented. These procedures were instituted to address urgent needs in the agricultural sector. Nevertheless, they basically cover most needs and tend to become the normal procedure. These procedures are evaluated here in terms of their effects on the labor market and on the employment status of foreigners.
